These Terms and Conditions apply to the goods sold by " BAUGRES SA" from its online store www.baugres.gr  (hereinafter for brevity it will be referred to as the "COMPANY" or " BAUGRES " or " www.baugres.gr ").

Statement

The sale of goods offered through the online store concerns wholesale users. The contract is addressed exclusively to traders and commercial companies, since its subject is, as mentioned above, the wholesale sale of goods. For this reason, the provisions of articles 2 and 3 of the Code apply where wholesale is defined as the sale of goods and the provision of services to another professional and to the persons of paragraphs 3 and 4 of article 2 of this Code, for the exercise of the profession them or the execution of their purpose, the sale of goods and the provision of services outside the country, as well as the sale of import rights.

The company reserves the right to unilaterally modify or renew the present terms and conditions of transactions, made through its online store, and undertakes the obligation to inform users of any modifications as well as any change, through the website of this online store. Any change of terms, policies, prices, etc. will not concern completed orders, which will be in the process of being shipped or delivered.

The names, images, logos and distinguishing features that represent the online store or contracted third parties as well as their products or services are exclusive trademarks and distinctive features of www.baugres.gr  or of the above third parties and are protected by Greek, Community and international trademark, industrial, intellectual property and unfair competition laws.

Your access to this website should in no way be construed as granting a license or right to use any symbols, words, images, graphics, photographs, designs, texts, services provided and products displayed, for which our prior written consent is required or any third party owner thereof.

Preparation of the sale

  1. Once the "Completion of Purchase" field is clicked, the customer makes a proposal to purchase the goods in his cart.
  2. The confirmation of receipt of the purchase proposal, which is automatically sent immediately after the submission of the order, certifies that the customer's order has been received by the Company, but this in itself does not constitute acceptance of the customer's purchase proposal.
  3. The acceptance of the proposal for purchase will be done only after the statement of acceptance of the proposal from the company's side, which will be sent with a newer electronic message confirming the order with confirmation of shipment or confirmation of readiness for collection from the store (if the buyer chooses this option .
  4. The customer must read and is required to agree and accept the application of these Terms of Use and the Privacy Policy regarding the Protection of

Personal Data in order to complete the process.

Product Availability

  1. We make every effort to update our online store regarding the availability of our warehouse. However, in the event that the products ordered are not available, despite the fact that they appear as such, the Company reserves the right not to accept the specific order and, consequently, not to complete the sale. The customer will be informed accordingly. Any payments will be refunded to the customer immediately and without undue delay, in the same way the customer chose to make the payment, unless otherwise agreed (if for example the customer wishes us not to refund the amount, but to keep it for a future purchase). Any other agreement – except for the immediate refund by the Company – will be confirmed by sending an e - mail to the address [email protected]
  2. With regard to the products displayed with the indication available "to order", the customer will be informed within two (2) working days as to whether and when the products will become available and consequently, their delivery will be possible .
  3. We take every technical and organizational measure regarding the indication of the correct price on the products, or the quantity per unit of measurement. It is possible that by mistake, due to a human or technical factor, an incorrect price will be listed, which obviously could not correspond to a usual or average sale price of the corresponding product. In such a case, the customer will be informed accordingly. Payments of the customer pending or executed payments will be cancelled. Any payments will be refunded to the customer immediately and without undue delay, in the same way that the customer chose to make the payment, unless otherwise agreed (there is for example the possibility, if the customer wishes, not to refund the amount and to set off with future market). Any other agreement – except for the immediate refund by the Company – will be confirmed by sending an e - mail to the address [email protected]
  4. We try - in collaboration with our suppliers - for the correctness and correct display of the products. However, there is the possibility of small deviations in the colors, which may be due to the lighting during the photography, or even to the resolution of the user's screen. If you're not sure, don't hesitate to ask us.
  5. We make every effort to process  your order. However, there is a possibility that it will be delayed, for reasons that do not concern the Company:
    a. There is a case that the product has been delayed by our supplier. In such a case, we will contact you to ask if you would like us to deliver the order without this product or suggest an alternative. We will send this item to you immediately after receiving it in our warehouses.
    b. The product you ordered is not available. There are cases when the supplier (manufacturing plant) suddenly and without warning announces that it is discontinuing a product or series that is already in our online store. We will contact you directly to find all alternatives.
    c. Cases of extreme weather or strikes as well as in any case of force majeure, which may affect the transport and delivery of your order.
    d . Cases where telephone or electronic communication with you is impossible, due to incorrect information you provided to us when completing the order.

Receive Order - Execution

The processing of the orders received by the Company takes place from Monday to Friday, from 08:00 am. until 17:00. Orders placed on Saturdays, Sundays and holidays are processed the next business day.

The delivery time of an order may also be affected by the payment method chosen by the customer (e.g. the completion and appearance time of the bank transfer may vary depending on the Bank (usually 2-3 working days).

In the case where the customer can choose the transport by his own means and expenses, then the products are transported at his own risk, and are treated by the Company as "receipt from the headquarters".

The shipping partner will contact the customer by phone within the same or next business day from the electronic notification of the shipment, in order to arrange the exact delivery time.

To pick up the order, the customer will show the external carrier partner the order confirmation and shipment notification, as well as an official identification document (such as a national ID card, passport or driver's license). It is pointed out that, as after the delivery of the products, the risk passes to the customer, he must check the products received by the customer upon receipt, as with his signature upon receipt, he confirms that he has correctly received the products of his order.

If the customer does not receive the product after receiving the notification to send and despite the relevant notification from the carrier, the Company reserves the right to withdraw from the sale. In such a case, the customer will receive a credit note, which will be paid by the Company in the same way as the customer paid the price , minus any transport/shipping costs.

Under no circumstances is delivery or collection to or from a minor permitted, not even upon authorization. The Company expressly reserves all its rights, including the right to consider the sale invalid or withdraw from it.

Products delivery

The products are delivered in two ways: by collection from our headquarters or by shipping to the place of choice.

A. Collection from our headquarters
This method of receipt is FREE.

But there are rules and special regulations. The buyer must inform the transport company  that he wishes to pick up the product he bought from our headquarters (and our warehouse). Collection must be completed within five (5) working days of completion of the purchase and notification by us that the order is ready for collection.

Our office is open for collection from Monday to Friday and from 09.00 in the morning to 16.00 in the afternoon. You should also take into account holidays and public holidays, as well as possible periods of time (eg summer vacations) during which it will not be possible to receive from our headquarters. The opening hours and the days of the week when we can serve you are listed on our website in a prominent place.

It is pointed out that, as after the receipt of the products, the risk passes to the customer, he must check the products he receives upon receipt, as with his signature upon receipt he confirms that he has correctly received the products of his order.

If the customer does not receive the product within five (5) working days of receiving the notification for collection, the Company reserves the right to withdraw from the sale. In such a case, the customer will receive a credit note equal to the sale price, which will be paid in the same way that the

customer chose to make the payment .

B. The shipment to the place of your choice
The second delivery method is shipping to the location of your choice. In this case there is a charge.

Delivery times: if the item is available, it is dispatched on the next working day. If not available it will be sent as agreed.

Same Day Delivery can only be carried out in the urban areas of the Urban Development Complex of Thessaloniki, of course given the availability of the product in the Company's Warehouse. It is only valid for orders placed from Monday to Friday until 12:00 and, if the relevant order confirmation is sent with confirmation of dispatch of the product. It applies to orders paid by credit/debit card or deposit to a bank account, as long as this appears in the company's e- banking application (it does not apply to interbank money transfers from one bank to another).

The shipment of large volumes of products may create the need for the use of an elevator or crane in order to transport them safely, which entails an additional charge in each case. In these cases the delivery time may be extended depending on the availability of the cooperating carriers. Otherwise, the delivery takes place at the external entrance of the place of dispatch (e.g. the entrance of an apartment building).

For shipments within the Urban Development Complex of Thessaloniki, as long as the order has been placed and confirmed by 12:00, delivery will be made on the next working day. Orders placed and confirmed by 12:00 on Friday will be delivered by Monday.

For shipments outside Thessaloniki, as long as the order has been placed and confirmed by 13:00, delivery will be made within 3 working days.

In remote areas, islands, etc. delivery can take up to 5 working days. However, we will make sure to inform you about this immediately (it is important that you include phone numbers in the orders so that we can also contact you by phone for such arrangements)

In any case, the shipment is selected to the place chosen by the customer, the product is delivered to an external partner for transport and delivery to the customer and the customer is informed electronically that the product is ready for shipment. Shipping costs are calculated based on the customer's order. Our calculation of the weight of the order – where this plays a role in the costs – is based on the official forms that accompany the products or are posted on the official websites of the companies.

However, the matter of the place of dispatch of these concerns the customer. Any incorrect entry by the customer and, as a result, incorrect calculation of shipping costs is not borne by the Company, but by the customer.

Delivery and return costs: the buyer chooses the transport company that will carry out the shipment and bears the transport costs.

Returns Policy

In case it is found upon receipt that the product is defective, a written notification follows to the customer service department at the e-mail address [email protected].

Returns are made only with cooperating transport companies. In this case, and only if there is a factory/production  problem, the company will bear the return shipping costs. If the buyer, for any reason, wants to return the product, he must contact us by phone or in writing and burdened  the costs of the return shipping himself. In both cases, a refund cannot be made without prior consultation with the company. The process is completed through the partner carrier

The product must be in its original condition, with all its accessories, accompanying forms, unused, its packaging undamaged (closed) and including the original contents in excellent condition.
The customer is responsible for returning the product. The cost of transportation is borne by the customer, except for the exception mentioned in item 2 above.

The return declaration is made in writing and/or electronically and the company is obliged to send a confirmation of receipt of the return declaration as soon as it receives it.

For hygiene reasons, basin covers cannot be returned.

For material quality reasons, returns are not accepted on all tiles.

Product return procedure

  1. You ensure the safe shipment of the product. Pack the product in a larger box to protect it during transport.
  2. Place the return slip and the return authorization slip inside the package
  3. You inform the Customer Service Department by phone or by e-mail at [email protected]
  4. Send the package through the partner agency. We would like to point out that in case the product does not meet the aforementioned conditions, it will be returned to the sender at the sender's expense.

Payment

  1. All prices in our online store are in euros, and do not include the statutory VAT, which is calculated additionally, and before the completion of the order.
  2. Upon completion of the order process, the customer can choose the payment method shown, i.e. by cash on delivery, by credit card, by electronic deposit to a bank account, via PayPal, or by cash at our headquarters.
  3. Transactions over €500.00 may not be carried out in cash, therefore it is not possible to choose cash on delivery in this case.
  4. The data entered by the customer when making an electronic payment are not controlled or processed or stored by the Company, but by the respective provider and/or payment server. MasterCard , Visa , Diners and American Express credit cards are accepted . The customer can also choose to make a transaction with a MasterCard , Visa and American Express credit card with a range of up to 36 interest installments. All cards participate in the installment plan. The modern Secure method is used to encrypt the data Socket Layer - (SSL).
  5. If payment by electronic bank deposit is chosen through one of the Banking Institutions collaborating with the Company, in which the latter maintains a bank account

    the order is completed with the shipment in parallel with the appearance of the bank transfer made by the customer to the corresponding bank account of the Company. The time of completion and appearance of the bank transfer may vary depending on the Bank (usually 2-3 working days). If the deposit is not made within 3 working days, the order is automatically cancelled.
  6. In the event that a refund is required, this will be carried out by the Company in the same way as the customer paid the price, unless otherwise agreed with the customer, without fault or unjustified delay.

Retention of ownership

The products remain the property of the Company until the final, full and complete payment of the price to it.

Right of withdrawal / Product return
You have the right to withdraw without reason from the distance sale exclusively within a period of 14 calendar days, returning the product in its original condition. This right starts from the day of receipt of these instructions in writing, however not before the delivery of the products. The sending of the clear statement of withdrawal or the sending of the products within 14 calendar days will be considered sufficient for the timely exercise of the right of withdrawal. You should know that if you exercise your right of withdrawal in any of the ways described above, you will receive confirmation of receipt of the exercised right of withdrawal.

The products are returned at the customer's expense with a partner carrier of the Company or sent with a carrier of his choice to our headquarters.

Consequences of withdrawal

Product that is returned with a carrier of the customer's choice and not with an external transport partner of the Company, is returned at the customer's risk. The customer is responsible for the return costs and for any reduction in the value of the product, for which the Company expressly reserves the right to determine until receipt of the returned goods. Once the product has been received and checked for any impairment of its value, any monetary obligation to it (e.g. paid delivery, return, value reduction) will be returned to the customer in the manner in which this payment was made by the customer, unless otherwise agreed with him. The refund obligation will be fulfilled without undue delay and within 14 calendar days of the return of the product.

Depreciation of returned product

The buyer should handle each product he receives in the same way he would handle and examine it in a physical store, in order to ascertain its nature, characteristics and function. Management of a product, which is different from the above description, will not be accepted. Therefore, the buyer may be charged with the reduction in the value of a product, if the management he has done to it exceeds the acceptable measure.

Indicative Cases of value reduction:

Products returned with damaged packaging will be subject to a 10% refund reduction.

Products, which are returned without packaging or accompanying documents, will be subject to a 15% reduction in the returned value.

Products, which are returned without accessories, any gifts, accompanying products and materials, will be subject to a reduction in the returned value of 30%.

Procedure for Exercising the Right of Withdrawal

In case of valid exercise of the right of withdrawal and provided that the product has been returned to the Company, the customer will receive a credit note equal to the sale price, which will be paid in the same way as the customer made the payment of the price, unless otherwise agreed with the customer, without fault or undue delay.

The Company reserves the right to refuse a refund until the product is returned to it or until the buyer provides proof of dispatch of the product, whichever occurs first. It is expressly agreed and the customer already provides his irrevocable order and consent to this, that the Company is entitled to withhold from the returned amount the return costs, which are borne by the customer (as well as any compensation in case of destruction, wear or damage of the product or impairment of the value of the product due to actions of the customer.

The Company, in any case, is entitled to claim in any legal way any amount that was damaged (indicatively, either with regard to return costs or with destruction, wear and tear, impairment of the value of the product, etc. ). It is expressly agreed, already during the pre-contractual stage before the order is submitted, that the Company is entitled to withhold part of the price and offset any loss resulting from a reduction in the value of the product with the refund amount in case of withdrawal. The present condition is one of the unconditional conditions for the conclusion of the contract and the legal basis thereof.

Final provisions

In case of non-application of any term of this agreement, the others remain in full force and effect.
Modification of the terms described above will only be made. For the resolution of any disputes arising from the visit or use of this website, disputes that will arise from the drawing up of a contract of sale, through this website, the Courts of Thessaloniki are established in accordance with Greek law.
The terms of use and the privacy policy have been drawn up in December 2022 by the lawyer Leonidas Seitanidis (member of the Board of Directors of Thessaloniki - [email protected]). The company will periodically review the Terms of Use, depending on the needs that arise.
